
Terms of Service

These terms govern your use of the Daybreak mobile app ("Daybreak", "the app", "we"). By downloading or using the app you agree to them. If you do not agree, please do not use the app.
1. The service
Daybreak generates a daily morning briefing from your calendar, local weather, and — for subscribers — AI-written text. The app requires iOS permissions (calendar, location, notifications) to deliver its full experience; it degrades gracefully if you decline them.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Daybreak on Apple-branded devices you own or control, for personal, non-commercial use, in accordance with these terms and Apple's App Store terms. This license supplements, and does not replace, Apple's standard Licensed Application End User License Agreement.
3. Daybreak Plus subscriptions
- Daybreak Plus is an auto-renewing subscription (monthly or yearly) that unlocks AI-personalized briefings. Prices are shown in the app before purchase.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your App Store account settings; access continues until the end of the paid period.
- Refunds are handled by Apple under Apple's policies.
- The free tier provides rule-based briefings and may change over time.
4. AI-generated content
Briefing text, including the daily focus and morning message, is generated automatically — by AI for Plus subscribers and by rules otherwise. It is provided for general informational and motivational purposes only. It may be inaccurate, incomplete, or oddly phrased, and it is not professional, medical, financial, or safety advice. Weather data comes from third parties and may be wrong. Always verify anything that matters — especially weather-dependent or time-critical decisions.
5. Acceptable use
You agree not to: reverse engineer, decompile, or tamper with the app or its briefing service; use the briefing service outside the app or attempt to overload or abuse it; use the app in violation of law; or resell or redistribute the app or its output as a service.
6. Your content
Your calendar data and preferences remain yours. You grant us only the limited right to process them — as described in the Privacy Policy — to generate your briefings. Briefings you share via the share sheet are shared at your discretion.
7. Intellectual property
The app, its design, logo, and name are owned by the Daybreak developer and protected by applicable intellectual property laws. These terms grant you no rights other than the license above.
8. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that briefings will be accurate.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us in the twelve months before the claim arose, or US$50 if you paid nothing.
10. Termination
You can stop using Daybreak at any time by deleting the app. We may suspend or terminate access to the briefing service for abuse or violation of these terms. Sections 4 and 7–9 survive termination.
11. Changes
We may update these terms as the app evolves. The current version always lives at this page with its effective date above. Continuing to use the app after changes take effect means you accept them.
12. Governing law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules.
